Fair Work Commission finds NDIS not yet a reason to increase flexibility in the SCHDSI Award

According to an article written by Russell Kennedy Lawyers, the Fair Work Commission handed down a decision on the review of modern awards for part-time and casual employment. 

Disability services providers previously made submissions for changes to the current part-time employment provisions in the Social, Community, Home Care and Disability Services Industry Award 2010. They argued that NDIS requires greater flexibility in allocating working hours to part-time employees in order to meet client's needs. They also claimed that without the award changes, providers would need to increase the hiring of casual employees to meet the demands for more individualised services.

The Commission, however, decided not to make changes to the award at this point. They believe it is too early in the NDIS implementation to conclude that we cannot work with the current part-time employment award, and that the trend towards casual employment at the expense of part-time roles would be permanent. The only significant award change they intend to make for now is to allow electronic communication, including by text message, for roster changes. The Commission also accepted that they might need to review their decision once NDIS has been fully implemented.
